Cash App Earned Pay Access Agreement
Effective: November 5, 2026
Last Updated: November 5, 2026
This Cash App Earned Pay Access Agreement (this “Agreement”) is between you, the Cash App account holder who accepts it, and Square Capital, LLC (“Square Capital,” “we,” “us,” or “our”). It governs each Advance you request through Cash App during the duration of this pilot. Cash App is provided by Block, Inc., with Square Capital providing the Advances covered by this Agreement.
Please read this Agreement and keep a copy. Each time you request an Advance, we will show you the amount, the Expected Paycheck Date (defined below), and other transaction-specific information described below before you accept. Those disclosures form part of this Agreement for that Advance.
Important information about your Advance
No cost. We charge no interest, setup fee, delivery fee, subscription or membership fee, late fee, expedited delivery fee, returned-payment fee, cancellation fee, or other fee for this pilot. We do not request nor do we accept tips, gratuities, or donations.
Repayment. You authorize us to deduct up to the full amount of your Advance from one Qualifying Paycheck deposited into your Cash App balance during the disclosed Collection Window. Several Advances awaiting the same paycheck may be deducted together, but never for more than their combined outstanding amounts or the amount available from that paycheck for this product.
No obligation to cover a shortfall. You are not obligated to pay an Advance from other sources of funds. If no Qualifying Paycheck arrives by the end of the Collection Window, the entire unrecovered amount is forgiven.
Future access may stop. If an Advance is not fully recovered, you may lose access to additional Advances. After the Collection Window expires, you may regain access by voluntarily repaying the unrecovered portion of the Advance in full, subject to continuing eligibility, as described in Section 7. Nonpayment of an Advance will not restrict your access to your other Cash App services or funds.
1. Definitions and transaction disclosures
An “Advance” is an amount Square Capital provides to your Cash App balance under this Agreement.
The “Collection Window” is the period during which we may recover an Advance from a Qualifying Paycheck. It begins two calendar days before the next Expected Paycheck Date following your Advance to accommodate variations in payroll timing, including holidays, and ends on the following Expected Paycheck Date. The Expected Paycheck Date is estimated based on prior payroll data. We will not begin collection before the Collection Window or extend it for that Advance after acceptance.
The “Expected Paycheck Date” is the date we estimate you will receive a Qualifying Paycheck, based on prior payroll deposits. It is an estimate, not a guarantee about when your employer will pay you, and not an unconditional payment due date.
A “Qualifying Paycheck” is a settled ACH payroll deposit that we identify as eligible wages or salary and that is credited to your Cash App balance during the Collection Window shown for your Advance. It may come from an employer different from the employer whose deposits were used to determine your offer. A transfer from another person, tax refund, government benefit, child-support payment, or payment from another wage-advance provider is not a Qualifying Paycheck. Debit-card deposits and other non-ACH deposits are not Qualifying Paychecks.
Before each Advance, we will show you:
The Advance amount and the amount to be added to your Cash App balance, which are the same.
Your then-current available amount and any other Advances awaiting recovery from the same paycheck.
The next Expected Paycheck Date
The Collection Window dates for the Advance.
That your cost is $0 and that there is only one Qualifying Paycheck recovery opportunity, with no fallback debit.
The effect of incomplete recovery on future access, and links to this Agreement and the applicable Square Capital privacy notice.
2. Eligibility and available amounts
To receive an Advance, you must be at least 18 years of age and legally able to enter into this Agreement, have an eligible personal Cash App account, complete required identity verification, and receive Qualifying Paychecks. Sponsored Accounts and Cash for Business Accounts are not eligible.
We determine your available amount using information such as your payroll deposit history and applicable eligibility criteria. Your available amount is an estimate based on your prior deposits; we do not verify your hours worked or obtain a timecard from your employer. An offer is not a representation that a particular amount of wages has already been earned or is guaranteed to be paid.
You may request more than one Advance before a paycheck, up to the amount shown in Cash App as currently available to request. This amount is not an amount that accrues each day or a promise of continuing access. We may increase, reduce, suspend, or discontinue offers prospectively, subject to applicable law. A later change does not increase the amount recoverable for an existing Advance or change its Collection Window.
This feature is subject to change and may not be available in all locations or for all customers.
3. Receiving and using an Advance
After you accept an offer, we will provide the Advance to your Cash App balance. You may use the funds for personal, family, or household purposes, subject to the terms that otherwise govern your Cash App account.
Your employer does not provide the Advance under this Agreement. This Agreement does not assign your wages to Square Capital or direct your employer to deduct or send wages to us. Any recovery occurs only after a Qualifying Paycheck has been credited to your Cash App balance and only as authorized below.
4. No fees, interest, or tips
We do not charge interest or any fee for eligibility, access, funding, delivery, reimbursement, nonpayment, or forgiveness under this pilot. We do not require a subscription, membership, and do not solicit or accept a tip. The total amount we may receive for repayment of an Advance, including an authorized paycheck deduction and any voluntary manual repayment under Section 7, will not exceed the amount actually provided to you.
This no-cost offer is a limited pilot, and we may stop offering new Advances at any time in our sole discretion. We will notify you of any material changes to the terms of this Agreement, including termination of the pilot. We will not later impose a fee or interest on an Advance accepted under this Agreement. Any future product with different pricing or recovery terms would require separate disclosures and acceptance before you use it.
5. Qualifying Paycheck authorization
By accepting the authorization displayed with each Advance, you authorize Square Capital and Block, Inc., acting to process the payment, to make one deduction from the first Qualifying Paycheck credited to your Cash App balance during that Advance’s Collection Window. You may also make voluntary manual repayments at any time, and the authorized deduction may not exceed the smaller of (a) the unrecovered amount of that Advance and any other Advances you authorized in anticipation of that same Qualifying Paycheck, or (b) the portion of that paycheck available for this product.
Other payment obligations may take priority under the arrangements governing your Cash App account. We do not guarantee that the full amount of your paycheck will be available for this Advance. If only a portion of the paycheck is available for this product, the same one-opportunity and forgiveness rules apply.
If several Advances are awaiting that paycheck, we may process one combined deduction. A Qualifying Paycheck uses the one recovery opportunity even if it results in a partial deduction or no deduction. We will not take a second deduction from another paycheck, resubmit an unsuccessful deduction, or use another payment source to recover the shortfall. This does not prevent you from initiating a separate, voluntary manual repayment after the Collection Window expires, as described in Section 7. Completing a previously initiated processing operation may not result in duplicate recovery or exceed the amount authorized for that operation.
This authorization does not permit us to debit your linked debit card or external bank account, take funds that were already in your Cash App balance before the Qualifying Paycheck, or use other Cash App funds such as savings, investments, or bitcoin. It is not a continuing authorization for future Advances. Once you accept this authorization, you cannot cancel it, except to the extent applicable law requires otherwise. You may end your participation in the product at any time. For the avoidance of doubt, ending your participation in the product does not cancel this authorization for an existing Advance. Nothing in this Agreement limits any nonwaivable right to revoke an authorization, stop a payment, or dispute an electronic fund transfer under applicable law.
6. Nonrecourse treatment and forgiveness
Your Advance is nonrecourse. This means you have no legal obligation to repay any amount we do not recover from your Qualifying Paycheck. We will not sue you for nonpayment, engage a collection agency to recover an unrecovered or forgiven amount, sell it as debt, or report nonpayment to a consumer reporting agency. Nonpayment alone is not a breach of this Agreement. Except for the Qualifying Paycheck deduction you authorize in Section 5, you have no contractual obligation to reimburse us from other sources of funds. If the authorized deduction from a Qualifying Paycheck does not recover the full amount, we bear that loss.
Immediately after the earlier of the processing of the authorized deduction from a Qualifying Paycheck or the end of the Collection Window, we will not attempt to collect any remaining amount. A forgiven amount is no longer owed. We will not revive it as a legally enforceable debt, demand payment, or attempt further automatic recovery, including from a later paycheck. You may nevertheless choose to make a voluntary manual repayment after the Collection Window expires to regain access as described in Section 7. A voluntary manual repayment does not revive a legal obligation to repay any forgiven amount.
If a Qualifying Paycheck used for recovery is subsequently reversed, we will not make a second recovery attempt or create a new reimbursement obligation for the affected Advance. This does not limit any refund or error-correction rights you have under applicable law or the terms governing your Cash App account.
7. Future access and your other Cash App services
If your Advances are fully recovered upon receipt of a Qualifying Paycheck, you may remain eligible for new offers for Advances, subject to our eligibility criteria. Full recovery does not guarantee a future offer, an increased available amount, or reopening of previously suspended access.
If an Advance is only partly recovered or not recovered, we may stop making new Advances available to you. After the Collection Window expires, you may regain access by voluntarily repaying the unrecovered portion of the Advance in full through the manual repayment option in Cash App, subject to continuing eligibility. Any amount already recovered or manually repaid will be credited toward that Advance so that you do not repay more than the amount you received. Each manual repayment requires your separate authorization and does not authorize recurring payments or another automatic recovery attempt. You are not permitted to manually repay using a credit card. You are not legally obligated to make a manual repayment, and choosing not to do so is not a breach of this Agreement; however, access to additional Advances may remain unavailable until the unrecovered portion is repaid in full. Failure to reimburse an Advance, by itself, will not cause us to freeze your Cash App balance, block your access to your own funds, or restrict other Cash App services. Separate restrictions permitted or required for reasons unrelated to nonpayment, such as account security or legal compliance, remain subject to the applicable account terms and law. This Agreement does not create a cross-default under another Cash App product.
8. Statements, receipts, and errors
We will make information about your Advance and any recovery or forgiveness available in Cash App. A receipt will distinguish the amount provided, the amount recovered, the amount forgiven, and any subsequent voluntary manual repayment. After recovery and forgiveness are complete, the affected Advance will have no remaining amount that you are legally obligated to pay. Cash App may separately display the amount you may voluntarily repay to regain access under Section 7; that display does not mean a forgiven amount is legally owed.
If you believe a deduction was unauthorized, duplicated, taken from the wrong deposit, or otherwise incorrect, contact Cash App Support using the steps outlined in Section XII.2 of the Cash App Terms of Service (Error and Dispute Resolution).
9. Information, privacy, and electronic records
You agree to provide accurate information reasonably needed to establish eligibility for this pilot, and to keep your Cash App contact information current. We use account and payroll-deposit information to evaluate offers and administer authorized recovery as described in the applicable privacy notices. This Agreement does not authorize us to obtain information from your employer that we do not otherwise have permission to obtain.
Please review the [SQUARE CAPITAL PRIVACY NOTICE — INSERT VERIFIED URL] and the Cash App Privacy Notice applicable to your account. Electronic delivery and signatures are governed by your applicable E-Sign consent. We will make this Agreement, transaction disclosures, and your authorization available in a form you can retain.
10. Ending participation and changes
You may stop requesting Advances at any time without penalty. Subject to the protections in Section 5, ending participation does not cancel the authorization for an existing Advance, expand our collection rights, or reverse forgiveness.
We may remove this feature or change terms for future Advances, subject to applicable law, required notice, and any required acceptance. We will not apply a change retroactively to impose a fee, extend a Collection Window, add a payment source, or revive a forgiven amount for an existing Advance.
11. Binding Individual Arbitration
Disputes are governed by the arbitration provisions in the Cash App Terms of Service.
12. Other terms and protections
The terms governing your Cash App account continue to apply to that account and its other services. For the cost, recovery, forgiveness, and nonpayment consequences of an Advance, this Agreement controls over inconsistent general payment, setoff, collection, or default language, to the fullest extent permitted by law.
We may use service providers to administer this Agreement, but doing so does not enlarge any recovery right or reduce your protections. Any permitted transfer of this Agreement must preserve its nonrecourse, no-fee, single recovery-opportunity, and forgiveness limitations; a forgiven or unrecovered amount may not be transferred for debt collection.
Nothing in this Agreement waives rights or remedies that cannot lawfully be waived. Any independently established rights relating to fraud remain subject to applicable law; a failure to reimburse, an insufficient paycheck, or cancellation of an authorization is not by itself fraud and does not revive a forgiven Advance.
Electronic acceptance. By obtaining an Advance, you agree to this Agreement and the transaction disclosures shown for the Advance.
